Fulfillment of information obligation


FULFILLMENT OF INFORMATION OBLIGATION TOWARDS OWNERS OF PERSONAL DATA PROCESSED BY TROPICAL TADEUSZ OGRODNIK CHORZÓW UL. OPOLSKA 25

This document is drawn up in order to fulfill the information obligation pursuant to Article 13 of Regulation (EU) No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJE L119 of 04.05.2016).


§ 1 Personal data controller
In accordance with the requirements of Article 13 of the GDPR (Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC) Tropical Tadeusz Ogrodnik informs that it processes personal data and is the controller thereof on the basis of Article 6(1) of the GDPR. Individuals whose personal data are processed by Tropical Tadeusz Ogrodnik have the right to access the content of their data and to demand that it be corrected, supplemented, rectified, transferred, forgotten or restricted, as well as the right to object to its processing. This right can be exercised at the Tropical Tadeusz Ogrodnik Office in Chorzów, ul. Opolska 25.

§ 2. Personal data
Personal data shall mean information about an identified or identifiable natural person ('data subject'); an identifiable natural person is one who can be identified, directly or indirectly, in particular by an identifier such as his or her name, surname, identification number, location data, an internet identifier or one or more of the physical, physiological, genetic, mental, economic, cultural or social characteristics of individuals.


§ 3. Powers with respect to data processing
Every owner of personal data has the right to demand from Tropical Tadeusz Ogrodnik access to his or her personal data, their correction, deletion, transfer or limitation of processing or the right to object to their processing.
The scope of the personal data processed results from the applicable law and the data are processed pursuant to Article 6(1) of Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
Tropical Tadeusz Ogrodnik also informs about the right to lodge a complaint with the Supervisory Body, in accordance with the provisions of the Act on Personal Data Protection, in case it is found that the processing of these data does not comply with the applicable national and European law. The Supervisory Authority is the Office for Personal Data Protection in Warsaw, ul. Stawki 2.


§ 4. Scope of data processing
Fulfilling the information obligation towards the owners of personal data which we contact by means of information and communication technology, we inform you that your e-mail address or telephone number is processed in our company for communication purposes, pursuant to Article 6, paragraph 1f of the GDPR.

Scope of data processing: e-mail address, telephone number, name, address, first and last name, content of the information in case of:

a) Potential contractors
Data has been collected on the basis of voluntary consent, which can be withdrawn at any time. The lack of consent or its withdrawal will be connected with the lack of possibility of contact and with the lack of possibility of preparing marketing offers of the Controller.

b) Contractors
Your personal data are processed in our company for purposes related to business cooperation or the delivery/purchase of goods and services and are processed within the scope of the concluded contract of sale or other business agreement pursuant to Article 6.1(b) of GDPR. Within the scope of fulfilling the obligations resulting from the law (tax purposes, accounting, claims recovery), the data are processed pursuant to Article 6.1(c) of GDPR and within the scope of debt collection and legal services, the data are processed pursuant to Article 6.1(f) of the GDPR. Providing the information in order to cooperate is necessary for the realization of the purchase or service as well as for issuing an invoice and their failure to provide it makes it impossible to perform a specific economic event.

c) Employees
Your personal data are processed in our company for employment purposes and are processed within the scope of the concluded contract and other additional agreements pursuant to Art. 6.1(b) of GDPR. In the scope of fulfilling the obligations resulting from the law (tax purposes, accounting, pension provision, OHS, training, working time settlement, social), the data are processed on the basis of Article 6.1(c).

The provision of data for employment purposes is a statutory requirement and failure to provide such data prevents employment.


§ 5. Source of collection of personal data
Personal data was collected from various sources, i.e.
  • directly from you, which we consider to be consenting to by performing a specific activity or signing a consent for telephone and e-mail contact
  • from public websites (categories: ordinary data, e-mail address, telephone number, name and surname, address)

§ 6. Time of processing of personal data
The data will be processed until we receive an objection to their processing or demand their deletion, unless the law obliges Tropical to further process the data or their processing is otherwise necessary for legal reasons.


§ 7. Transfer of data to third parties
The recipients of your personal data are defined by law and include also companies operating information systems. The above mentioned data are not made available to anyone without the consent of the data subject, unless the access is required in order to settle the matter in the justified interest of the Controller, e.g. in the field of mail maintenance, the data are made available to Poczta Polska, couriers, hosting services providers, telecommunications operators, companies operating IT systems.
